THIS IS A BINDING LEGAL AGREEMENT BETWEEN YOU (THE "USER") AND [MEIBI US, LLC], A LIMITED LIABILITY COMPANY ORGANIZED UNDER THE LAWS OF THE STATE OF [DELAWARE / STATE OF FORMATION], WITH A REGISTERED ADDRESS AT [INSERT U.S. BUSINESS ADDRESS] ("MEIBI," "WE," "US," OR "OUR"), GOVERNING YOUR USE OF AND ACCESS TO THE WEBSITE LOCATED AT GETMEIBI.COM (THE "SITE") AND ANY PURCHASES MADE THROUGH IT.
BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS ("TERMS"). IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SITE.
Privacy Policy — The separate document made available on the Site explaining what personal information we collect, how we use it, and your rights regarding it.
Meibi / We / Us / Our — [Meibi US, LLC], the operator of the Site.
User Account — The unique, non-transferable, personal account created by a User upon registration.
Personal Information — Any information that identifies, relates to, or could reasonably be linked with an identified or identifiable individual.
Site — The e-commerce platform operated by Meibi at https://getmeibi.com, dedicated to the marketing of sexual wellness toys, accessories, and supplements, along with related educational content.
Products — The toys, accessories, and sexual wellness supplements offered for sale on the Site.
User — Any person who accesses, browses, and/or uses the Site, including anyone who purchases Products through it.

These Terms govern: (i) access to and use of the Site; (ii) registration and use of a User Account; and (iii) the purchase of Products. By using the Site in any of these ways, you agree to be bound by these Terms in their entirety.
You must be at least 18 years old to access the Site, create an account, or purchase Products. By using the Site, you represent and warrant, under penalty of law, that you are at least 18 years of age and have the legal capacity to enter into this agreement. Meibi reserves the right to request age verification and to deny access or cancel orders where age cannot be reasonably confirmed.
The Site, its content, and its Products are not intended for, marketed to, or appropriate for minors.
Meibi grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site strictly for your personal, non-commercial use, subject to these Terms.
You may not: print, download, copy, reproduce, republish, distribute, transmit, display, sell, license, or otherwise exploit any content, image, text, or material from the Site for any purpose other than personal use, without Meibi's prior written consent. Any violation will result in immediate revocation of this license without notice.
By accessing and using the Site, you electronically accept these Terms. If you do not accept them in full, you must refrain from accessing or using the Site. These Terms are made available in the Site footer and at the time of newsletter subscription, and may also be presented for acceptance during checkout.
Registration, access, and use of the Site must be personal. Your account credentials are confidential and non-transferable, and you are responsible for all activity conducted under your credentials.
The Site is generally available 24/7/365, except during scheduled maintenance, of which Meibi will provide notice where reasonably possible.
While using the Site, you may not:
Spread false, misleading, or deceptive information.
Engage in fraudulent, illegal, threatening, abusive, harassing, defamatory, discriminatory, obscene, vulgar, offensive, or indecent conduct.
Encourage conduct that could constitute a crime, give rise to civil liability, or violate any applicable law or regulation.
Infringe the intellectual property, privacy, publicity, or other rights of third parties.
Transmit viruses, malware, or other harmful code.
Reverse-engineer, decompile, or disassemble the Site.
Use bots, scrapers, or similar automated tools to extract data or content without prior written authorization.
Run any program or code intended to extract, index, mine, or otherwise harvest data from the Site, or to overload, disrupt, or impair its operation.
Attempt to gain unauthorized access to, or otherwise damage, any part of the Site.
7.1 Registration. To create an account, you must provide: full name, email address, and password. Meibi will send a confirmation email to the address provided.
7.2 Accuracy. You agree to provide and maintain accurate, complete, and current account information.
7.3 Purpose. An account allows you to save basic information for future purchases and to track order status.
7.4 Responsibility. You are solely responsible for keeping your password confidential and for all activity occurring under your account. You must notify Meibi immediately of any unauthorized use of your account. Meibi is not responsible for losses or damages arising from your failure to safeguard your credentials.
7.5 Non-transferability. Accounts are personal and may not be sold, assigned, or transferred for any consideration.
7.6 Password Recovery. Use the "Forgot your password?" option and follow the instructions sent to your registered email.
8.1 Listings. Meibi will display an accurate and current image, name, specifications, and price for each Product offered.
8.2 Pricing. Prices are listed in U.S. Dollars (USD) and do not include applicable sales tax, which will be calculated and added at checkout based on your shipping address as required by applicable state law.
8.3 Price Changes. Meibi may modify Product prices at any time. Any change made after you place an order will not apply retroactively to that order.
8.4 Availability. Product availability is not guaranteed and depends on stock and demand. Meibi disclaims liability for unavailability of any listed Product.
9.1 Process. To purchase, select the desired Product and variant, add it to your cart, and proceed to checkout. You will be asked to provide your email, full name, shipping address, and other required information.
9.2 Payment Methods. Payment may be made via credit/debit card or other payment processors made available on the Site (e.g., PayPal, or similar third-party processors). By providing payment information, you agree to the applicable third party's own terms and privacy policy.
9.3 Authorization. You authorize Meibi and its payment processors to charge your selected payment method for the full order amount, including applicable taxes and shipping. You release Meibi from liability for unauthorized or improper use of your payment card resulting from your own actions or omissions.
9.4 Order Acceptance. Meibi reserves the right to refuse or cancel any order at its discretion, including in cases of suspected fraud, pricing errors, or unavailability of stock, in which case you will be notified and refunded in full for that order.
10.1 Discreet Packaging. Orders are shipped in discreet, unmarked packaging that does not reference the contents or Meibi by name on the exterior, unless otherwise stated.
10.2 Delivery. Products are shipped via Meibi's logistics provider(s) to the address provided at checkout. Delivery is deemed complete once the Product is made available at that address. Order status updates will be sent to the email address provided.
10.3 Shipping Fees. Shipping costs are calculated based on the total order amount and added to the order total, itemized at checkout.
10.4 Restricted Destinations. Meibi currently ships only within the United States [and its territories, as applicable]. Meibi reserves the right to decline shipment to any address where applicable state or local law restricts the sale or shipment of sexual wellness products.
⚠️ Decision needed: Many U.S. sexual-wellness retailers adopt a "final sale due to hygiene" policy for opened/used intimate products, rather than Meibi México's 5-day return window. Confirm which approach you want; the language below offers a hygiene-conscious U.S.-style policy as a starting point — adjust to match your actual operations.
11.1 Eligibility. Due to the intimate nature of our Products, all sales are final once a Product has been opened, used, or removed from its original sealed packaging, except in cases of manufacturing defect (see Section 12, Warranty) or as required by applicable law.
11.2 Unopened Products. If a Product remains sealed and unused, you may request a return or exchange within [5] days of delivery by contacting team@getmeibi.com with your order number. The Product must be returned in its original, unopened packaging with all tags and seals intact. Meibi reserves the right to refuse returns that do not meet these conditions.
11.3 Refund Processing. Approved refunds will be issued to the original payment method within a commercially reasonable time after Meibi receives and inspects the returned Product.
11.4 Defective Products. See Section 12 below.
Products for which a warranty is expressly indicated on the Site carry a one (1) year limited warranty against manufacturing defects in the motor or other internal components, excluding damage from misuse, normal wear, or unauthorized modification.
To make a warranty claim, you must provide: (i) your order number and the email used for the order; (ii) a photo of the Product including all accessories (charger, remote, pouch, etc.); and (iii) a video, between 1 and 5 minutes long, clearly showing the defect, how the Product is charged and powered on, and (for battery-operated items) that the battery functions correctly in another device.
Upload the photo and video to a cloud storage service (e.g., Google Drive) and email the shareable link to team@getmeibi.com with the subject line "Order #[number] – Warranty Claim."
EXCEPT AS EXPRESSLY STATED IN THIS SECTION, ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
By providing your email, you authorize Meibi to send newsletters, marketing content, and promotional communications, in compliance with the U.S. CAN-SPAM Act. You may opt out at any time by clicking the unsubscribe link included in every promotional email. Opting out of marketing emails does not affect transactional emails related to your orders.
14.1 Site Content. Meibi does not guarantee the accuracy, reliability, or completeness of the content (text and images) on the Site. You release Meibi from liability regarding the suitability or reliability of such content.
14.2 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, MEIBI, ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MEIBI'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
14.3 Continuity. In the event of a Site outage, Meibi will provide support via email.
All content on the Site — including text, photographs, illustrations, graphics, designs, code, data, and other materials — is the exclusive property of Meibi and is protected under U.S. copyright, trademark, and other applicable intellectual property laws, as well as international treaties.
Use of the Site does not grant you ownership of, or a license to exploit, any such content. Downloading any content from the Site is strictly prohibited. Meibi's trademarks, logos, and trade dress may not be used without Meibi's prior written consent.
Meibi collects and processes Personal Information as described in our [Privacy Policy], available at getmeibi.com/privacy. By using the Site, you acknowledge that you have reviewed the Privacy Policy.
California Residents: If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA/CPRA), as described in our Privacy Policy, including the right to know, delete, correct, and opt out of the sale or sharing of your personal information.
17.1 To the Site. Meibi may at any time modify, add to, or discontinue any content, feature, or Product on the Site without liability to Users.
17.2 To These Terms. Meibi may modify these Terms at any time. Material changes will be communicated at least [30] days in advance via posting on the Site and/or email notification. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
These Terms remain in effect indefinitely from the date of publication. Meibi may, with notice where reasonably possible, terminate this agreement, suspend Site access, or discontinue the Site at any time.

19.1 Governing Law. These Terms are governed by the laws of the State of [INSERT STATE, e.g., Delaware], without regard to its conflict-of-laws principles, and applicable U.S. federal law (including the FTC Act and other consumer protection statutes).
19.2 Informal Resolution. Before initiating formal proceedings, you agree to first contact Meibi at team@getmeibi.com to attempt to resolve the dispute informally.
19.3 Binding Arbitration. Any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally will be resolved by binding individual arbitration administered by [American Arbitration Association (AAA) / JAMS] under its rules then in effect, rather than in court.
19.4 Class Action Waiver. YOU AND MEIBI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
19.5 Exceptions. Either party may bring an individual action in small claims court, and either party may seek injunctive relief in court for infringement of intellectual property rights.

21.1 Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
21.2 No Waiver. Meibi's failure to enforce any right or provision will not constitute a waiver of that right or provision.
21.3 Assignment. Meibi may assign or transfer its rights and obligations under these Terms without your consent, in compliance with applicable law. You may not assign your rights or obligations without Meibi's prior written consent.
21.4 Indemnification. You agree to indemnify and hold harmless Meibi, its affiliates, suppliers, vendors, and advisors from any claim, demand, or action — including reasonable attorneys' fees — arising from your breach of these Terms.
21.5 Headings. Section headings are for convenience only and do not affect interpretation.
21.6 Electronic Communications. You consent to receive communications from Meibi electronically, and agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing.
21.7 Force Majeure. Meibi is not liable for delays or failures in performance resulting from causes beyond its reasonable control.
